Economic Benefits Agreement between Treaty 8 and British Columbia


In February 2008, four of the B.C. Treaty 8 First Nations entered into an Economic Benefits Agreement (“EBA”) with the Province of British Columbia. The agreement is the first step in a series of interrelated bilateral agreements to address issues of revenue sharing and collaborative resource management in Treaty 8 territory in British Columbia. In December 2009, three of the four First Nations and British Columbia signed an Amended EBA as well as four other agreements: Government to Government Protocol Agreement, Strategic Land and Resource Planning Agreement, Wildlife Collaborative Management Agreement and Parks Collaborative Management Agreement. In May 2010, the three First Nations and British Columbia signed a Final Agreement along with four other agreements: Long Term Oil and Gas Agreement, Forest and Range Agreement, Crown Lands Agreement, and Culture and Heritage Agreement.

While none of these agreements is a Treaty under section 35(1) of the Constitution Act, 1982, the Final Agreement and the resource management sub-agreements are intended to re-frame the relationship between the three Treaty 8 First Nations and the government of British Columbia:
